Achasta, the one gated golf community

If your definition of a gated community includes a golf course, a clubhouse and a real amenity package, Dahlonega has one: Achasta. Our Achasta community page describes it as a 1,400-acre gated community, and the community's official site describes 18 holes of play on a Jack Nicklaus-designed course that intertwines with the Chestatee River for over half its yardage. The same official site lists pickleball courts, walking trails, and a river park and swimming pool among the amenities.

Two things follow from that for a buyer, and both are worth asking about early. First, a golf community and a golf membership are separate purchases in most clubs, so confirm in writing what your closing does and does not include and request the current membership plan from the club rather than relying on a listing remark. Second, an amenity-rich community carries an amenity-rich cost structure, which is a question for the association's current documents and budget rather than for any article. The smaller gated enclaves, and the private ones that are not gated

The other four communities in the table are residential rather than resort. They trade a clubhouse for elevation, acreage and quiet, and they tend to run on a small volunteer or self-managed association rather than a professional management company. That is not a defect, but it changes the diligence. In a small association the reserve for a gate motor, a culvert or a stretch of pavement may be a single line on a one-page budget, and the person who can explain it is a neighbor rather than a management portal.

Two well-known Dahlonega addresses belong in this section for the opposite reason.   • A quieter road for walking, because the traffic behind the gate is residents and their guests
  • A defined community boundary, which is worth something at resale in a market full of scattered-site cabins

What it does not give you

  • A security guarantee. A code-entry gate controls convenience and traffic, not crime
  • County road maintenance. Behind most gates the pavement is the owners' responsibility, not the county's
  • Freedom from assessments. The gate itself is a shared asset with a shared repair bill
  • Automatic access for deliveries, contractors, guests or short-notice service calls

The covenant questions Georgia law makes worth asking

Two owners can live in identical houses behind identical gates and be governed by very different legal regimes, because in Georgia a residential association is only governed by the Property Owners' Association Act if its documents opted in. O.C.G.A. 44-3-222, titled creation of property owners' development and affirmative election to be governed by article, puts it plainly: any declaration or amendment intending to bring or avail a development of the benefits and provisions of this article shall state an affirmative election to be so governed. Ask which regime applies to the community you are buying into, and ask to see the language, not a summary of it.

The reason it matters shows up in the assessment sections. O.C.G.A. 44-3-232 is titled assessments against lot owners as constituting lien in favor of association, additional charges against lot owners, procedure for foreclosing lien, and obligation to provide statement of amounts due. Inside that section the statute states that the recording of the declaration pursuant to this article shall constitute record notice of the existence of the lien, and no further recordation of any claim of lien for assessments shall be required. In plain terms, in a community governed by that article you cannot reason from the absence of a separately filed lien that there is no assessment lien exposure. The same section carries an obligation to provide a statement of amounts due, which is precisely the document a buyer should be requesting before closing. O.C.G.A. 44-3-223 covers compliance with the instrument and the rules, and the penalties for noncompliance, which is where a community's enforcement teeth live.

Private roads, gate hardware and emergency access

A gate implies a private road, and a private road on a north Georgia slope is a real asset with a real replacement cost. Grades are steep, cuts erode, culverts silt up, and a single winter can move the repaving conversation forward by five years. Before you fall for the view, ask who owns the pavement, who has repaved it most recently, and what is in reserve for the next time.

The gate hardware deserves the same treatment. A motorized gate is a machine exposed to weather and to lightning, and a community that has not budgeted for its replacement will discover the cost during the first storm season after you move in. Ask how the gate is opened, what happens during a power failure, and who is called when it sticks.

Then ask the question buyers almost never ask: how do first responders get in? Lumpkin County fire, EMS and the sheriff's office need reliable access, and different communities solve it different ways. Confirm the arrangement with the association and, if you want certainty, with the county, rather than assuming that someone has handled it. Step 1. Drive the entrance twice, once after dark

Look at whether the gate is closed, whether it works, and how a visitor without a code gets in. A gate that stands open every time you visit is a fence with a hinge, and you should price the home accordingly rather than paying for a feature you will not receive.

Step 2. Get the recorded declaration and read the whole thing

Not the sales summary, not the flyer. The recorded declaration and its amendments are the document that binds you. Ask specifically whether it states an affirmative election to be governed by the Property Owners' Association Act under O.C.G.A. 44-3-222, because that single sentence changes the legal framework around your assessments.

Step 3. Request the current budget, the reserve balance and a statement of amounts due

Ask what the association collects, what it spends on the gate and the roads, what sits in reserve, and whether anything is owed on the lot you are buying. In a community governed by the Property Owners' Association Act, O.C.G.A. 44-3-232 carries an obligation to provide a statement of amounts due, so this is a document to request rather than a favor to ask.

Step 4. Establish who maintains the road, in writing

Confirm whether the road is county-maintained or privately maintained, and if it is private, confirm which entity is responsible and how the cost is shared. Verify it with Lumpkin County rather than with a listing remark, and ask when the road was last resurfaced.

Step 5. Ask the association your use questions directly, and get the answer in the documents

Rentals of any length, guest occupancy, home businesses, recreational vehicles, boats, outbuildings, fences, exterior colors, tree removal and pets are all governed by the covenants rather than by convention. Ask the association what the current documents say about the specific use you have in mind, then confirm you can see it in the recorded language before you commit.

Step 6. Sit with the minutes and talk to two neighbors

Recent meeting minutes tell you what the community argues about, and a special assessment usually appears there long before it appears on a bill. Two conversations at the mailboxes will tell you more about how the gate and the road are actually run than any brochure.
