Georgia Power lakes: leases, docks and setbacks

Georgia Power's North Georgia lakes are Lake Burton, Lake Rabun, Lake Seed, Lake Yonah, Lake Tugalo and Tallulah Falls. Federal regulators place the project in Rabun, Habersham and Stephens counties, and Georgia Power's lake office is at 4 Seed Lake Road in Lakemont (706-746-1450).

Every homeowner needs a Georgia Power permit for any activity on Georgia Power land, on leased and deeded lots alike, and construction permits carry no fee. When you buy:

  • The agreement comes first. Georgia Power will not issue permits to a new owner, or validate existing shoreline structures, until the owner signs a legal agreement with the company.
  • Lease lots transfer at closing. Allow three to four weeks; a new as-built survey may be needed, and moving the lease into an LLC or trust costs $500.
  • Deeded lots are privately owned down to the high-water mark. Notify Georgia Power before closing.

Under Georgia Power's guidelines, a lot platted after 2000 needs 100 feet of straight-line shoreline for a dock (50 feet for older lots). A dock may not exceed 16 by 20 feet, or 320 square feet, each lot gets one shoreline structure, and new homes must sit at least 50 feet from the shoreline behind a 25-foot vegetative buffer. Georgia State Parks lists Lake Burton at 2,775 acres.

Short-term rental rules in Rabun County

Rabun County's rules, adopted December 27, 2022, cover rentals of less than 30 consecutive days. Each unit needs its own county license, renewed by December 31. What matters to a buyer:

  • The license does not transfer. It becomes null and void when the property sells.
  • Zoning. Rentals are permitted in the Vacation Cottage district (one-acre minimum for newer plats) and Highway Business. An owner with a homestead exemption who lives in the home at least 180 days a year may rent in any district. Older rentals in R-1, R-2, R-3 and agricultural zoning lose that status at sale.
  • Limits. No more than 12 occupants, and a local contact who lives in Rabun County and responds within two hours.
  • Cost. $50 per advertised occupant per year, plus an 8 percent county excise tax and Georgia's $5.00 per night hotel-motel fee.

Inside the towns. Clayton requires its own license for rentals of 30 days or less: $150 to apply, $100 a year to renew, a yearly fire inspection, and a new license for a new owner. Sky Valley's license also ends at sale, and Tallulah Falls allows rentals only in its business districts. Ask the County Marshal (706-782-2657) which licenses apply to a home in town.

Septic, wells and building in Rabun County

Septic. Rabun County Environmental Health (District 2 Public Health) is at 184 South Main Street in Clayton, 706-212-0294. New systems must be permitted and inspected before use, and not every lot can take one. The county issues no building permit without a septic permit unless the home will be on city or county sewer.

Wells. Rabun is not one of the District 2 counties that issue well construction permits, but District 2 does test water samples for bacteria. Add a water test to the inspection period for any home on a well.

Building. Rabun County Planning and Zoning, 18 Old Raco High Drive, Suite 102, Clayton (706-782-1579), issues building and land-disturbing permits, and power cannot be connected without a building permit. New homes need at least 672 square feet, or 400 if stick-built on site. Trout streams carry 50-foot or 25-foot buffers, depending on the stream.

Steep lots in Clayton. The city's mountain protection rules cover land 2,200 feet or more above sea level with a slope of 25 percent or more, and a building may not rise more than 40 feet above the ridge top. In town, the City of Clayton supplies water and sewer.

Parks, schools, health care and taxes

Black Rock Mountain State Park, at 3,640 feet the highest state park in Georgia, has 1,743 acres and 11 miles of trails. Tallulah Gorge is two miles long and nearly 1,000 feet deep. Warwoman Dell, a national forest recreation area, is 3 miles east of Clayton.

Rabun County Schools runs the public schools from Tiger, and Rabun Gap-Nacoochee School, founded in 1903, is a private boarding and day school. Wellstar Mountain Lakes Medical Center in Clayton is a 25-bed acute care hospital.

Homestead. File with the Rabun County Tax Assessor's Office by April 1 of the first year, with your warranty deed. The standard exemption is $2,000 off the 40 percent assessed value, and owners 65 and older with net income under $10,000 can claim $12,500 off the county portion.
